Judicial Officer Arrested on Bribery Charges Linked to Former Minister
In a significant development for Sri Lanka's fight against corruption, a judicial officer has been implicated in a bribery case involving former Deputy Minister Sarana Gunawardena, who is already facing charges related to the misuse of vehicles in his role as chairman of the Development Lottery Board. Reports suggest that a lawyer's assistant at the Colombo High Court was detained and ordered to be held in custody until September 22, after being accused of accepting a bribe of 750,000 rupees from Gunawardena's wife in exchange for a reduced penalty.
The High Court judge, Asanga Bodaragama, issued the custody order upon reviewing evidence presented by the Commission to Investigate Allegations of Bribery or Corruption. This evidence included allegations involving a court officer from the Attanagalla Magistrate's Court and a record-keeper at the Colombo High Court, prompting further investigations into their roles in facilitating corrupt practices.
The lawyer's assistant, identified as G.A. Charith Kumara, was arrested following a complaint lodged with the bribery commission by a judge at the Colombo High Court. The suspect was subsequently presented in court and remanded to custody.
Back in June, Gunawardena was sentenced to significant prison time by High Court Judge Mohamed Mihal for committing serious offenses related to his position. His sentence includes a 16-year term for various charges, which has raised public concern regarding the corruption seeped within high-ranking officials.
During the court proceedings, it was revealed that a phone conversation took place between the accused and the High Court judge, where the suspect inquired about ongoing cases with an assertion of, "Who are you to discuss cases with me?" The judge was said to have questioned the suspect for details.
According to court officials, the suspect indicated that it would not be possible to discuss the matter in detail at that moment but could arrange for a face-to-face meeting later. This has led to formal complaints being lodged with the bribery commission regarding the conversation.
Subsequent investigations revealed that the suspect had been in communication via 'WhatsApp' with Gunawardena's wife. The bribery commission indicated to the court that a bank account linked to 750,000 rupees had been repeatedly referenced in invoices issued by the suspect.
Further details emerging from the investigation noted that a bookbinder at the Colombo High Court allegedly accepted a bribe of 500,000 rupees, and the bribery commission has called upon him to provide testimony and statements on the matter. Additionally, inquiries surrounding another official from the Attanagalla Court are ongoing.
In court, the representative of the accused asserted that his client had acted in seeking the involvement of the High Court judge to avoid potential allegations following these transactions. The legal counsel characterized the facts of the case as complex and nuanced, urging caution in discussing any specifics.
Moreover, the defense indicated that the bank account referenced in messages on his client's 'WhatsApp' was not owned by him. The defense lawyer called for his client's release on bail, claiming the circumstances were disproportionately penalizing.
Considering the troubling implications of the case, the magistrate directed a thorough investigation into the roles of both the judicial officer and the High Court bookbinder linked to the situation, instructing that a report be submitted to the court without delay.
Ultimately, the request for bail was denied, with the magistrate ordering the suspect to remain in custody until September 22. The magistrate also mandated that the bribery commission report on the progress of the investigations by that date and directed that the suspect be brought back to court on the same day.
