LaGrange resident Gianna Fantina-Santana, age 43, was arrested following a traffic stop on New Hackensack Road in Wappinger at around 8:16 p.m. on Sunday, Sept. 6, New York State Police announced on Tuesday, Sept. 8.
According to the agency, troopers stopped Fantina-Santana as she was driving eastbound for alleged traffic violations and noticed signs of intoxication. After administering field sobriety tests, troopers learned that a 6-year-old child was riding in the vehicle, police added.
Fantina-Santana was taken into custody and given a chemical breath test that allegedly showed her blood alcohol content was 0.10 percent, above New York's legal limit of 0.08 percent, according to police.
The child was safely released to a sober third party.
Fantina-Santana was charged with aggravated DWI with a child passenger under Leandra's Law, a felony, as well as misdemeanor DWI and operating a vehicle with a BAC of 0.08 percent or higher, police said.
She was issued traffic tickets and is scheduled to appear in Wappinger Town Court on Oct. 20 at 5 p.m.
