Patna: The Patna high court on Tuesday ruled that an adopted son is entitled to be considered for compassionate appointment if the adoption is bona fide and not fabricated to obtain the benefit. A single bench of justice Kumar Manish, while allowing Vijay Kumar Sah 's writ application, directed North Bihar Power Distribution Company to consider his claim for compassionate appointment by treating him as the dependent of his adopting mother, his maternal grandmother, who died in harness in 2007 while working as a messenger at one of the company's supply division offices in Begusarai. Vijay's counsel Manindra Kishroe Singh submitted that his client was adopted by his maternal grandmother, Reshma Devi, at the age of 13 through a written adoption deed dated Feb 18, 1999, which was also notarised. Reshma died in harness in 2007. Vijay applied for compassionate appointment in 2010, but the company delayed the matter before rejecting his application on Dec 22, 2017, questioning his entitlement as an adopted son. Justice Manish held that adoption under Hindu law is complete upon giving and accepting a child in adoption. He said the power distribution company's rejection of Vijay's claim was based on a rigid and hyper-technical interpretation of Hindu law.
