柯文哲二審首開／柯文哲恐罪加一等 掏空眾望基金會案情新進展

由於背信罪為不得上訴第三審之罪，若柯文哲在二審遭依背信罪判有罪，即定讞得立即入獄，而檢察官未對背信罪上訴，可望簡化審理程序，加速二審判決時程，另本案承審法官呂寧莉審判品質獲肯定，預計誰明年8月調升最高法院，但高院庭務會議在柯文哲案上訴分案前已決定，柯文哲案承審法官在審結宣判前不能調動，因此，全案很可能在明年8月呂寧莉法官調職前宣判。
